General terms and conditions of business

By placing your order, you accept the following general terms and conditions.

Gender note: For reasons of easier readability, the usual masculine form of speech is used for personal nouns and pronouns in the terms and conditions. However, this does not imply discrimination against the female sex, but should be understood as gender-neutral in the interests of linguistic simplification.

1. General
The General Business Connections (GTC) apply to all contracts, deliveries and other services from Cetin Avci eU (hereinafter “the seller”) to the customer (hereinafter “the buyer”). The sale (order) between the seller

and the Buyer, shall be governed by these General Terms and Conditions ("GTC") with respect to the goods and services manufactured or arranged for manufacture by the Seller or purchased from third parties (hereinafter the "Goods") to the exclusion of any prior, oral or written agreements. Deviating regulations do not apply; we hereby expressly object to such. All ancillary agreements require our written confirmation. Austrian substantive law applies to the order to the exclusion of the UN Sales Convention. The contract language is German. Place of performance is Vienna.

2. Order and conclusion of the contract
The specified range of products on the website https://www.ungrade.at constitutes an invitation to the customer to make an offer to the company Odd C. Avci eU to purchase one of the products specified in the webshop, under the general terms and conditions specified on the same website.
All prices are in euros (EUR) and include the statutory value added tax (VAT). The presentation of the products in the web shop is not a legally binding offer, but represents a non-binding online catalogue. The respective product information is listed in the detail area of ​​the product. The goods presented on the website were photographed digitally, which means that there may be slight discrepancies between the presentation of the goods and reality. Such deviations do not represent a defect in the ordered goods. By ordering the goods, the buyer confirms that he has been informed about the essential properties of the goods.
By clicking the "BUY" button, the buyer places a binding order for the goods contained in the shopping cart with the seller. Immediately after receipt of the order, the buyer will receive a confirmation of receipt of his order at the email address he previously provided. The seller reserves the right not to accept the offer if an item is not available, if the buyer has not paid invoices for previous deliveries without justification, if his credit card check has not been successfully completed or if there are other justified doubts about his creditworthiness. If the seller cannot fulfill an order, he will inform the buyer immediately.
The buyer is asked to check his order again, especially the choice of products with multiple order variants (e.g. clips instead of plugs, several variants of metal color, etc.). Corrections to the order are possible as long as the package has not been dispatched. This is possible by contacting the seller (by email, phone or Whatts app). No changes can be made to the order once it has been shipped.
The use of the website or the online shop is only permitted for legal, adult and natural persons. Use is at your own risk. The buyer guarantees that he has disclosed his true identity and only correct data and that he is of legal age and has legal capacity when an order is placed.

3. Prices and Shipping
All sales prices include Austrian statutory sales tax.
The buyer can choose to pay for the goods in advance or by credit card (Stripe). When paying by credit card, the buyer's account will be debited upon completion of the order. After the payment has been made, the buyer receives a payment confirmation from the seller (in the case of payment in advance) or from the payment processing partner (Stripe).
After payment has been made, the seller sends the buyer an invoice by post or email to the specified email or postal address.
If the buyer is culpably in arrears with the payment, the company C. Avci eU is entitled to demand reminder fees and interest on arrears in the legally permitted amount. The seller reserves the right to only allow certain payment methods if the result of the address and credit check is negative.
After payment via credit card (Stripe) or prepayment to the account specified by the seller, all goods in the seller's warehouse will be shipped immediately.
After your order has been dispatched, the customer will receive an automatic dispatch confirmation by e-mail as well as an e-mail from Ö. Mail that includes the tracking number. With this, the customer can track his package at any time.
Delivery processing can take up to a week. Shipping is by Österreichische Post AG. Within Austria the delivery time is between 2-5 working days. For goods shipped internationally, the delivery time can be more than 5 days. However, delivery times are non-binding. Goods that are not in stock and have to be ordered will be sent to the buyer immediately after receipt of the goods.
Should delivery times be longer for other organizational reasons (e.g. holidays), customers will be informed of this on the website.
The standard shipping costs for Austria and abroad are listed on the website and are shown separately and visibly in the shopping cart. Shipping costs will be charged for the total order. All parcels are insured by Austrian Post up to a certain value: in Austria up to EUR 510.00 and in other EU countries up to EUR 100.00. If the customer wants a different shipping method, he must bear these costs himself.
In the standard case, the costs of packaging are borne by the seller. In the event of a return, the same must be used again. If the customer wants a different type of packaging, he must bear the costs himself.
When shipping to non-EU countries, additional duties such as customs duties, taxes, etc. may apply. These are collected by the respective state when crossing the border and can therefore not be accepted or reimbursed by Sanja Junker eU.

4. Retention of Title
The goods remain the property of the seller until full payment has been made by the buyer.

5. Warranty
Please check the delivery immediately upon receipt!
All parcels are insured by Austrian Post: in Austria up to a value of EUR 510.00 and in other EU countries up to EUR 100.00).
If delivered items are damaged in transit, please contact us within 48 hours and document the damage as well as possible. After your notification, we will create a damage report, which must be sent to Österreichische Post AG no later than 7 days after delivery (excluding Sundays and public holidays).
In the case of damaged goods, the buyer is entitled to a new product worth the purchase price. The seller bears the cost of shipping the replacement goods. Only in the event that the goods are not available or no replacement is possible will the buyer be fully reimbursed for the price paid including any shipping costs paid.
Monetary compensation is also paid if the seller delivered the wrong item and the goods cannot be exchanged for an equivalent item.


6. Liability
The seller is only liable to entrepreneurs for intent and gross negligence, but not for slight negligence. Liability for slight negligence is also excluded towards consumers. Any liability, with the exception of liability for intent, is limited to the amount of the purchase price of the goods. The seller warrants that the goods correspond to the descriptions contained in the order. However, there may be certain variations in style, color, size or finish, or irregularities in packaging. No guarantee/liability can be assumed for this.

Otherwise the legal regulations apply. However, the seller is not liable for damage that has not occurred to the goods themselves; in particular, the seller is not liable for lost profits or other financial losses of the buyer.

7. Right of Return and Withdrawal
Customer satisfaction is very important to us! Please read the return policy carefully.
The buyer is entitled to withdraw from the order within 14 working days after receipt of the goods and to return the goods to the seller without giving any reason. This right of withdrawal only applies to consumers within the meaning of the Consumer Protection Act and not to entrepreneurs.
The period for online orders of goods begins on the day the goods are received by the customer (§11 Para. 2 FAGG).
Please re-use the packaging supplied if you wish to return the product.
The costs of returning the goods are to be borne by the buyer. Returned products must be in their original condition: jewelry boxes must be fully intact, products must be new and unworn. Personalized pieces of jewelry cannot be exchanged or returned. We strongly recommend shipping with a tracking number, as Odd C. Avci eU cannot be held responsible in the event of the package being lost in the post. No postage paid packages can be accepted. Refunds will be processed using the original payment method used at the time of purchase.
Alternatively, the order can also be returned free of charge in the shop at Siebensterngasse 54, 1070 Vienna within 14 working days of receipt of the goods or the items can be exchanged.

You can use the attached sample form for the revocation, but this is not mandatory. An informal message by e-mail is also sufficient for us. You are not obliged to tell us the reasons for the return, but we would be very grateful if we could find out about them. In this way we can improve our products and services in the future.

The invoice amount to be refunded can be reduced accordingly by the seller if the items are affected by signs of use, are damaged or are incomplete.

In the event of an effective withdrawal, a full (if the entire order is returned) or a partial refund (if partial orders are returned) will take place. The prerequisite for this is the unused and resaleable condition of the goods. If this is not provided, the seller reserves the right to withhold the refund of the purchase price if necessary. Any shipping costs originally paid for the order will only be reimbursed in the event of complete cancellation. This does not apply if the customer has selected a special type of delivery or packaging (e.g. express delivery). In this case, the customer has to pay the difference to the standard delivery/standard packaging himself.
In the case of a partial return, any shipping costs paid will not be refunded.

Important for “orders free of shipping costs”: We offer free delivery from a certain order value. If the value of the goods falls below the limit of the "order free of shipping costs" due to the partial return, the usual shipping costs will be retained.

Exchange: currently it is not possible to exchange the goods online. However, the buyer is free to place a new order at any time and to return the originally ordered goods. It is also possible to exchange ordered products in the shop ( Siebensterngasse 54 , 1070 Vienna) free of charge within a period of 14 working days. Please contact us if you would like to exchange the goods you have ordered.


8. Repayment processing for returns
As soon as the returned goods have been received and checked by the seller, the buyer will receive confirmation of receipt and, if applicable, a credit note. The obligations to reimburse payments must be fulfilled within 14 days of receipt of the return. The same means of payment will be used for this repayment that the buyer used in the original transaction, unless something else was expressly agreed with him.
